While the above efforts are a good start, it must also be noted that many trucking accidents happen because truck drivers break the law and do not operate their trucks in a safe manner on Georgia roads. This negligence forms the basis for a trucking accident lawsuit. For instance, Under Georgia code § 40-6-52 it is against the law for large trucks — which are defined by the state of Georgia as vehicles with more than six wheels that are not buses or motorcoaches – to operate in any lanes other than the two most right-hand lanes on roads or highways with three or more lanes. Trucks also must stay in the right lane on roads or highways with two lanes except when overtaking and passing another vehicle or preparing for a left turn. Many of the most severe accidents are caused by violations of these laws by truckers in an effort to speed up their route and increase profits. This creates unsafe conditions that can lead to serious, and sometimes, deadly accidents on the roads of Georgia.
This is a good example of how trucking accidents are similar to car accidents in that the driver of the at-fault vehicle must comply with all “rules of the road” and drive in a safer and non-negligent manner which does not cause injury and damages to others who are on the road. However, trucking cases are different in that truckers are subject to most safety related rules and laws due to the potential catastrophic effects that can happen when over the road trucks are involved in accidents, especially on the Georgia interstates.
